END-USER LICENSE AGREEMENT FOR
LIFESTORIES PRESENTS:
DAVE TAYLOR'S AFRICAN SAFARI
UNDERSTANDING THE SERENGETI-MARA ECOSYSTEM

IMPORTANT - PLEASE READ CAREFULLY:

For the purposes of this license, the individual person, family, school, or organization who purchases the LifeStories Educational CDROM product is hereafter called THE PURCHASER.

This LifeStories End-User License Agreement ("LEULA") is a legal agreement between you, THE PURCHASER, and LifeStories for the LifeStories educational CDROM product identified above and included and associated media, images, audio files, printed materials, and "online" or electronic documentation. By installing, copying, or otherwise using the educational CDROM product, you agree to be bound by the terms of this LEULA. If you do not agree to the terms of this LEULA, do not install or use the LifeStories educational CDROM product.

LifeStories Educational CDROM product LICENSE

This LifeStories Educational CDROM product is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The LifeStories Educational CDROM product is licensed, not sold.

1. GRANT OF LICENSE & COPYRIGHT AGREEMENT

ALL digital information contained in all LifeStories CDROMs is protected by copyright. All title and copyrights in and to the LifeStories Educational CDROM product (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the LifeStories Educational CDROM product), the accompanying printed materials, and any copies of the LifeStories Educational CDROM product are owned by Dave Taylor and James Cash. The LifeStories Educational CDROM product is protected by copyright laws and international treaty provisions. Therefore, you must treat the LifeStories Educational CDROM product like any other copyrighted material except that you may copy and use the LifeStories Educational CDROM product within the limits of this license outlined below.

For the purposes of this license, the individual person, family, school, or organization who purchases the LifeStories Educational CDROM product is hereafter called THE PURCHASER.

THE PURCHASER has permission to make as many copies of LifeStories as needed for full use within and on the premises of THE PURCHASER'S premises. Any individuals who are recognized members of the aforementioned THE PURCHASER'S organization (e.g., in a school: students, teachers, and school administration personnel) also have permission to copy LifeStories digital information (images and/or text) into their own documents for any EDUCATIONAL USE whatsoever so long as a reference is made to the material in a footnote or bibliography or reference list.

DIGITAL MATERIAL CONTAINED IN THE LIFESTORIES EDUCATIONAL CDROM MUST NOT BE SOLD OR RE-PACKAGED FOR PROFIT OR ANY OTHER PURPOSE.

THE PURCHASER does not have permission to share any copies of any LifeStories digital information with any other individual, business, organization, family, school board, or educational institution of any kind or size, in any form. That is, all LifeStories digital information must be used within and remain on the premises of THE PURCHASER'S organization.

BY REMOVING THE SHRINK-WRAPPING ENCASING ANY LIFESTORIES CDROM, THE PURCHASER LEGALLY AGREES TO ABIDE BY THE END-USER LICENSE AGREEMENT WITHOUT DEVIATION. For copyright protection reasons, CDROMs cannot be returned to the distributor or LifeStories for refund after the shrink-wrapping has been removed.

STORAGE/NETWORK USE: You may also store or install a copy of the LifeStories Educational CDROM product on a storage device, such as a network server, on THE PURCHASER'S organizational premises. LifeStories CDROM products can then be accessed by any number of computers which are connected to the network AND which are located within the same premises of THE PURCHASER. A LIMIT OF NO MORE THAT 100 NETWORKED USERS IS HEREBY LICENSED BY THIS LEULA TO USE THE LIFESTORIES EDUCATIONAL CDROM PRODUCT AT ANY ONE TIME.

2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS

LIMITATIONS ON MODIFICATION OF HTML SOURCE CODE: You may modify in any way the HTML source code of any LifeStories Educational CDROM product, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

SEPARATION OF COMPONENTS: The LifeStories Educational CDROM product is licensed as a single product. However, its component parts CAN be separated for use on more than one computer so long as any computer using the product is located within the premises of THE PURCHASER.

RENTAL: You may not rent, lease, or lend the LifeStories Educational CDROM product.

SUPPORT SERVICES: LifeStories may provide you with support services related to the LifeStories Educational CDROM product ("Support Services"). Support Services are limited to the self-help area within the website located at the following URL: http://www.lifestories.com/dtwrl-help. The LifeStories Education CDROM product is content and NOT software. For support services related to a WWW Browser program used to view the LifeStories Education CDROM product, please refer to that software's manual and/or website for Support Services.

LIFESTORIES EDUCATIONAL CDROM TRANSFER OF OWNERSHIP AND RIGHTS: You may permanently transfer all of your rights under this LEULA, provided you retain no copies, you transfer all of the LifeStories Educational CDROM product (including all component parts, the media and printed materials, any upgrades, this LEULA), and the recipient agrees to the terms of this LEULA.

TERMINATION: Without prejudice to any other rights, LifeStories may terminate this LEULA if you fail to comply with the terms and conditions of this LEULA. In such event, you must destroy all copies of the LifeStories Educational CDROM product and all of its component parts.

3. MISCELLANEOUS

This LEULA is governed by the laws of the Province of Ontario, Canada.

If this product was acquired outside Canada, then local law may apply.

WARRANTY INFORMATION: NO WARRANTIES ARE MADE AS TO THE ACCURACY, COMPLETENESS, OR CURRENCY OF ANY OF THE INFORMATION CONTAINED ON "LIFESTORIES PRESENTS: DAVE TAYLOR'S AFRICAN SAFARI" HEREINAFTER CALLED "THE CDROM". TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIFESTORIES AND ITS DISTRIBUTORS AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH REGARD TO THE LIFESTORIES EDUCATIONAL CDROM PRODUCT.

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIFESTORIES OR ITS DISTRIBUTORS OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE LIFESTORIES EDUCATIONAL CDROM PRODUCT OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF LIFESTORIES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, LIFESTORIES' ENTIRE LIABILITY UNDER ANY PROVISION OF THIS LEULA SHALL BE LIMITED TO THE GREATER OF THE AMOUNT ACTUALLY PAID BY YOU FOR THE LIFESTORIES EDUCATIONAL CDROM PRODUCT OR CDN $1.00.
